Welcome to Brewed! These Terms and Conditions (“Terms”) govern your use of the Brewed mobile application (“App”) and related services. By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using Brewed, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use the App.

2. Description of Service

Brewed is a coffee tracking and brewing recipe application that allows users to:

• Record and track coffee bean information (origin, region, farm, processing method, variety)
• Create and store brewing recipes with detailed parameters
• Manage personal coffee brewing data and preferences
• Access personalized coffee brewing experiences

Future features may include social sharing capabilities and community features, which will be subject to these Terms when implemented.

3. User Accounts

Account Creation

• You must use Sign in with Apple to create an account
• You must provide accurate and complete information
• You are responsible for maintaining the security of your account
• You must be at least 13 years old to use the App

Account Responsibilities

• You are solely responsible for all activities under your account
• You must notify us immediately of any unauthorized use of your account
• You may not share your account credentials with others
• You may not create multiple accounts for the same person

4. Acceptable Use

Permitted Use

You may use the App for personal, non-commercial purposes to track and manage your coffee brewing activities.

Prohibited Activities

You agree not to:

• Use the App for any unlawful purpose or in violation of these Terms
• Upload, post, or transmit any harmful, offensive, or inappropriate content
• Attempt to gain unauthorized access to the App or its systems
• Interfere with or disrupt the App’s functionality
• Use automated systems to access the App without permission
• Reverse engineer, decompile, or attempt to extract source code
• Violate any applicable laws or regulations

5. User Content

Your Content

• You retain ownership of any content you create or upload to the App
• You grant us a limited license to store and process your content to provide the App’s services
• You are solely responsible for the accuracy and legality of your content
• You represent that you have the right to upload any content you provide

Content Standards

All user content must:

• Be accurate and truthful
• Comply with applicable laws and regulations
• Not infringe on third-party rights
• Not contain harmful or malicious code

Future Sharing Features

When social sharing features are implemented, additional terms regarding public content and community guidelines will apply.

6. Intellectual Property

App Ownership

The App, including its design, functionality, and content (excluding user-generated content), is owned by the App developer and protected by intellectual property laws.

Limited License

We grant you a limited, non-exclusive, non-transferable license to use the App for personal purposes in accordance with these Terms.

Restrictions

You may not:

• Copy, modify, or distribute the App
• Create derivative works based on the App
• Use the App’s intellectual property without permission

7. Privacy and Data

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information. By using the App, you consent to our data practices as described in the Privacy Policy.

8. App Availability and Updates

Service Availability

• We strive to maintain App availability but cannot guarantee uninterrupted service
• We may temporarily suspend the App for maintenance or updates
• We reserve the right to modify or discontinue features with reasonable notice

Updates

• We may release updates to improve functionality and security
• Updates are optional unless required for security or legal compliance
• Continued use of the App after updates constitutes acceptance of changes

9. Account Termination

Termination by You

You may delete your account at any time through the App settings or by contacting us. Upon deletion, all your personal data will be permanently removed from our systems.

Termination by Us

We may suspend or terminate your account if you:

• Violate these Terms or our Privacy Policy
• Upload harmful, illegal, or inappropriate content
• Engage in activities that harm the App or other users
• Fail to comply with applicable laws

Effect of Termination

Upon termination, your right to use the App ceases immediately, and we may delete your account and associated data.

10. Disclaimers and Limitations

Service Disclaimer

The App is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising from your use of the App.

Coffee Brewing Disclaimer

The App provides information and tools for coffee brewing. We do not guarantee the quality or safety of coffee prepared using the App’s suggestions. Users are responsible for their own coffee preparation and equipment use.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses arising from your use of the App, violation of these Terms, or infringement of third-party rights.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of the jurisdiction where you reside (Japan, Australia, or the United States), without regard to conflict of law principles. Any disputes will be resolved in the courts of competent jurisdiction in your country of residence.

13. Changes to Terms

We may update these Terms from time to time to reflect changes in our services or legal requirements. When we make changes:

• We will update the “Effective Date” at the top of these Terms
• For material changes, we may notify you through the App or other means
• Your continued use of the App after changes constitutes acceptance of the updated Terms

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions will continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the use of the App and supersede all prior agreements and understandings.
